TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, software, artificial intelligence features, communications tools, lead-management services, integrations, and related products and services provided by Super Social, LLC (“Super Social,” “we,” “us,” or “our”).
These Terms apply to our public website located at supersocial.biz and www.supersocial.biz (http://www.supersocial.biz/), our application at app.supersocial.biz, and any related websites, applications, APIs, integrations, products, or services we operate (collectively, the “Services”).
By accessing or using the Services, creating an account, subscribing to the Services, connecting a third-party account, or otherwise using Super Social, you agree to these Terms.
If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
1. Super Social Services
Super Social provides software and related services designed to help businesses capture, organize, manage, understand, and respond to customer inquiries, leads, conversations, appointments, tasks, and related business activity.
Depending on your subscription, configuration, and available integrations, the Services may include:
• AI Receptionist functionality
• AI Assistant functionality
• lead and customer relationship management
• customer conversations and messaging
• phone and call handling
• SMS and text messaging
• WhatsApp
• Facebook Messenger
• Instagram messaging
• Threads integrations
• Meta Lead Ads and Instant Forms
• email communications
• website forms
• website chat
• appointment and calendar functionality
• advertising attribution and tracking
• analytics and reporting
• workflow automation
• third-party integrations
• other present or future Super Social features
Features may change, be expanded, replaced, suspended, or discontinued over time.
Certain features may require third-party accounts, third-party approvals, business verification, connected phone numbers, platform permissions, additional subscriptions, or usage-based charges.
2. Accounts and Authorized Users
You must provide accurate and complete account and business information and keep that information reasonably current.
You are responsible for maintaining the confidentiality and security of your login credentials and for all activity conducted through your account by you or your authorized users.
You may permit employees, contractors, or other personnel to use the Services on your behalf. You are responsible for ensuring that those users comply with these Terms.
You must promptly notify Super Social if you believe your account, credentials, connected channels, integrations, or data have been accessed without authorization.
3. Subscriptions, Fees, and Billing
Certain Services require payment of subscription fees, usage-based charges, or both.
Pricing, billing frequency, included features, trial terms, usage limits, and other billing information will be presented when you subscribe or through your account.
Unless otherwise stated, subscriptions renew automatically until canceled.
You authorize Super Social and its payment processors to charge your payment method for applicable subscription fees, usage charges, taxes, and other authorized amounts.
Failure to pay amounts when due may result in suspension or restriction of paid Services.
4. AI Receptionist
Super Social may provide a customer-facing AI Receptionist capable of communicating with prospective and existing customers on your behalf.
Depending on your configuration, the AI Receptionist may:
• answer customer questions
• collect lead information
• qualify inquiries
• provide configured business information
• perform intake
• route or escalate conversations
• assist with scheduling
• perform configured handoffs
• respond through connected communication channels
You are responsible for configuring the AI Receptionist with accurate business information, appropriate instructions, and appropriate escalation and human-review procedures.
5. AI Assistant
Super Social may provide an internal AI Assistant designed to assist business owners, employees, or authorized personnel.
The AI Assistant may help with:
• summaries
• lead reviews
• suggested follow-ups
• message drafts
• task organization
• reminders
• workflow assistance
• internal recommendations
• other configured business activities
Unless expressly configured and permitted, AI Assistant suggestions or drafts should not be treated as automatically authorized external communications or business decisions.
6. Artificial Intelligence Limitations
Artificial intelligence systems can make mistakes.
AI-generated responses, summaries, classifications, recommendations, transcriptions, decisions, or actions may be inaccurate, incomplete, inappropriate, or unsuitable for a particular situation.
You remain responsible for:
• determining whether the Services are appropriate for your business
• reviewing important or consequential outputs
• maintaining accurate business information
• supervising automated workflows
• providing appropriate human oversight
• complying with applicable laws and professional obligations
You must not configure or represent Super Social AI as a licensed professional when it is not.
The Services are not a substitute for qualified medical, legal, financial, emergency, or other regulated professional advice.
7. Communications and Connected Channels
The Services may connect to third-party communications platforms and channels, including phone, SMS, WhatsApp, email, Facebook Messenger, Instagram, Threads, web chat, website forms, advertising lead forms, and other services.
By connecting a channel, you authorize Super Social to receive, process, store, transmit, and respond to communications and related information as necessary to provide the Services.
You are responsible for obtaining all required permissions, notices, and consents related to communications made through your account.
You must comply with applicable laws governing:
• calling
• texting
• marketing
• electronic communications
• call recording
• consumer protection
• privacy
• anti-spam requirements
• opt-outs
• consent
Delivery of communications is not guaranteed. Third-party platforms, carriers, networks, messaging windows, templates, account status, recipient settings, or other factors may affect delivery.
8. Third-Party Platforms
Super Social may integrate with third-party providers such as Meta, Google, communications providers, payment processors, cloud providers, AI providers, and other technology services.
Your use of third-party services remains subject to the terms, policies, restrictions, and requirements of those providers.
Meta, for example, applies additional commercial and platform terms to businesses developing apps or using Meta products for commercial purposes.
You are responsible for maintaining valid authority to connect any account, Page, phone number, social account, advertising account, business asset, or other resource to Super Social.
Super Social does not control third-party platforms and is not responsible for:
• API changes
• platform outages
• provider pricing changes
• account suspensions
• access denials
• permission changes
• review or verification decisions
• discontinued features
You may not use Super Social to bypass or violate third-party platform rules.
9. Customer Data
You retain your ownership rights in information you provide through the Services, including business data, lead data, contact information, communications, documents, media, instructions, and other content (“Customer Data”).
You grant Super Social the limited rights necessary to host, process, transmit, copy, transform, analyze, and otherwise use Customer Data to provide, secure, support, maintain, and improve the Services and comply with applicable law.
You represent that you have the rights and authority necessary to provide Customer Data to Super Social.
10. Lead and Contact Data
Super Social may consolidate leads and contacts from multiple channels.
Lead matching, attribution, deduplication, classification, qualification, and analytics may depend on available information and may not always be exact.
You are responsible for determining whether you may lawfully collect, retain, contact, market to, or otherwise process each lead or contact.
You are also responsible for honoring applicable:
• consent requirements
• opt-out requests
• deletion requests
• privacy rights
• communication restrictions
11. Call Recording and Monitoring
Certain configurations may allow communications to be recorded, transcribed, monitored, or analyzed.
Recording and monitoring laws vary by jurisdiction.
You are responsible for determining whether recording or monitoring is lawful and for providing required disclosures or obtaining required consent.
12. Acceptable Use
You may not use the Services to:
• violate applicable law
• commit fraud
• impersonate another person or business
• harass, threaten, abuse, or discriminate
• send unlawful spam or unsolicited communications
• access data without authorization
• distribute malware
• interfere with the security or operation of the Services
• circumvent technical restrictions
• probe or attack systems without authorization
• violate intellectual-property rights
• violate privacy rights
• violate third-party platform requirements
• use Super Social in a manner that exposes Super Social or others to legal or security risk
13. Customer Configuration
You are responsible for accurately configuring information used by the Services, including:
• business hours
• services
• service areas
• pricing guidance
• FAQs
• appointment information
• routing instructions
• escalation contacts
• messaging rules
• permissions
• integrations
• communication settings
• AI instructions
You are responsible for testing important configurations before relying on them in production.
14. Security
Super Social uses administrative, technical, and organizational safeguards intended to protect the Services and data processed through them.
No internet-connected service can guarantee absolute security.
You are responsible for protecting credentials, limiting access to authorized users, and promptly removing access that is no longer required.
15. Intellectual Property
Super Social and its licensors retain all rights in the Services, including software, designs, user interfaces, documentation, trademarks, technology, and related materials, excluding Customer Data.
Subject to these Terms and payment of applicable fees, Super Social grants you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes.
You may not sell, sublicense, reverse engineer, copy, scrape, or commercially exploit the Services except where permitted by law or authorized by Super Social.
16. Feedback
If you provide suggestions, ideas, or feedback regarding the Services, you permit Super Social to use that feedback without restriction or compensation.
This does not transfer ownership of your Customer Data to Super Social.
17. Availability and Changes
Super Social may update, modify, replace, suspend, or discontinue portions of the Services.
We may perform maintenance or take actions necessary to protect users, data, infrastructure, or third-party integrations.
We do not guarantee uninterrupted or error-free operation.
18. Suspension and Termination
Super Social may suspend or terminate access where reasonably necessary, including for:
• material violations of these Terms
• unpaid fees
• illegal activity
• security risk
• misuse of the Services
• serious violations of third-party requirements
• legal or regulatory requirements
Provisions that by their nature should survive termination will remain effective.
19. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
SUPER SOCIAL DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
SUPER SOCIAL DOES NOT WARRANT THAT AI OUTPUTS, LEAD ATTRIBUTION, TRANSCRIPTIONS, SUMMARIES, AUTOMATED ACTIONS, THIRD-PARTY INTEGRATIONS, OR COMMUNICATION DELIVERY WILL ALWAYS BE ACCURATE, COMPLETE, AVAILABLE, OR ERROR-FREE.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPER SOCIAL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST GOODWILL, OR LOSS OR CORRUPTION OF DATA ARISING FROM OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPER SOCIAL’S TOTAL AGGREGATE LIABILITY ARISING FROM THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO SUPER SOCIAL DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not permit certain limitations, so some limitations may not apply to you.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Super Social, LLC and its officers, employees, contractors, affiliates, and agents from third-party claims resulting from:
• your Customer Data
• your misuse of the Services
• violation of these Terms
• violation of law
• violation of third-party rights
• communications initiated or authorized through your account

23. Changes to These Terms
We may update these Terms.
When changes are material, we may provide notice through the Services, by email, on our website, or through another reasonable method.
Continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by law.
